My understanding of new soakaways being installed within a property have to follow certain rules and statutory requirementsin particular Porosity Tests with Engineers Report and a SEPA Authorisation. I understand from previous correspondencewith the Scottish Borders Council that they do not hold Porosity Tests Reports.
1) In this vein, may I please ask to see all correspondence, emails, telephone notes and documentation in any format
whatsoever, between the Scottish Borders Council, SEPA and/or the owners/occupiers of Kirkurd House/Agents/Engineers (including
Glendinnings) of Kirkurd House, where there has been a relaxation/discussion in the householder/Agent providing Porosity Tests under
Building Warrant 15/00052/ERE?
2) May I please ask to see all correspondence, emails, telephone notes and documentation in any format whatsoever, between
the Scottish Borders Council, SEPA and/or the owners/occupiers of Kirkurd House/Agents (including Glendinnings) of Kirkurd
House, where it has been agreed between SEPA in particular and/or all or any of the aforementioned parties that the SEPA
Authorisation can or has been altered/amended to suit the Building Warrant 15/00052/ERE soakaway initially installed in 2014/2015
or any subsequent amendment to the Building Warrant, following its excavation and alteration in or about November 2018.
This is not a vexatious enquiry but one borne of a requirement for the Scottish Borders Council to disclose important information,
surrounding health and safety, which ought to be publically available.
Response
Scottish Borders Council believe this request to be vexatious. You have had all correspondence in relation to this file and have been previously notified of such.
This request represents the continuation of a pattern of behaviour which is deemed vexatious and the Council therefore relies on Regulation 10(4)(b) of the Environmental Information (Scotland) Regulation 2004.
To clarify, there is no additional information with regards to the sewage system and the pipe held by the Council.
All information held within the Building Warrant file has already been provided in response to previous requests in relation to Kirkurd house, subject to the redaction of personal data.
The Council has considered the public interest test in providing this information to you again and determined that there is no public interest in providing information that has already been repeatedly provided. It is not in the public interest that services are repeatedly burdened in this way.
