Freedom of Information (Scotland) Act 2002 ("the Act")Environmental Information (Scotland) Regulations 2004 -Information RequestWe would like to (and hereby do) make an Information Request that we be provided with all information collected by you pursuant to your statutory duty under Section 1 of Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947
for all Notices/Orders that:
(1) Have been Served,
(2) remain extant, (That is to say have been served but are not considered Complied with)
(3) Have been Complied with (Where there are no works left to be carried out)
(4) Have been Complied with but have invoices pending in respect of works carried out by or on behalf of your council,
During the dates 1st July 2020 to the 1st July 2021 which information would form part of any PEC issued by the Council were one to be issued.
Response
(1) The Scottish Borders Council (2 High Street/12 Market Place, Jedburgh) Compulsory Purchase Order 2020 has been prepared and served on all owners/interested parties. One objection was received in relation to this matter. A public local inquiry took place on 5 May 2021. The Reporter has sent his report to the Scottish Ministers for consideration. A final result is still outstanding.
(2) The Scottish Borders Council (Subjects at Clovenfords, Galashiels) Compulsory Purchase Order 2009 remains extant as the notice to treat process was used to take prompt entry on 6 September 2010, but compensation is still being resolved to enable title to be transferred. In respect of Area 1 compensation has been agreed and discussions regarding agreeing the terms of the conveyance to transfer title are at an advanced stage
