1. The number of people who submitted a Subject Access Request related to time spent in care of the local authority.2. The number of appeals/complaints made in relation to such requests.3. The number of requests that were fulfilled in the 30 day period.4. The number of requests that were not fulfilled in the 30 day period.
5. The number of social work cases opened to support people who has made a Subject Access Request related to time spent in care of the local authority.

I would be grateful if you could give me this data for the years:

2020 and

Scottish Borders Council advise that record retention for Subject Access Requests is 3 years as per record retention schedules followed in line with Scottish Council on Archives Record Retention Schedules and therefore advise that the figures for 2017 and 2018 although provided are incomplete as we do not hold full records for these years.

1. When providing figures for the request above we advise that the figures provided are in relation to requests by applicants who have either been in foster care or residential care.

2. 2017 –Zero requests where the client spent time in care of the local authority
2018 – Zero requests where the client spent time in care of the local authority
2019 – 2 requests where the client spent time in care of the local authority
2020 – Zero requests where the client spent time in care of the local authority
2021 – 1 request where the client spent time in the care of the local authority

2018- 1 over 30 days, 2 where department extended to 90 days and request was fulfilled within the 90 days
2019- 4 over 30 days these were extended to 90 days and fulfilled within this period, 4 over the 90 day timescale
2020- 1 over 30 days this was extended to 90 days and fulfilled within this period , 2 over the 90 day period
2021- 2 over 30 days this was extended to 90 days and fulfilled within this timescale, 3 over the 90 day period.

5. Scottish Borders Council apply S17of FOI(S)A to the above question as this information is not held.
We can advise that when a child has been in care for any reason and they have requested a copy of their Social Work file that they are given the opportunity to discuss any entry with Social Work should they wish on receipt of the file. If the case is an open case, the allocated Social Worker will discuss the content of the file on receipt with the client .
