This request is for information under the Freedom of Information Act 2000.How many formal complaints regarding a school staff member (for example, but not limited to teacher, headteacher, head of a department) did Peebles High school receive in the last ten years. Please could you break this information down by year, the department in which the staff member workedIn each case, please could you state whether any misconduct was found and, if so, what type of disciplinary action was taken, including verbal/written/final warnings, suspension, dismissal etc.Please proceed with the request on the basis that we are asking for information about complaints made.
Response
During the period 2016 to 2022, there have been 6 complaints relating to staff in Peebles High, none of which resulted in disciplinary action. On considering your request, it is determined that no further detail can be given in this regard as this would involve disclosing information which could lead to the identification of staff members.
Disclosure under FOISA means putting that information into the public domain under FOI. The information withheld under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002 (Personal information), as disclosure would breach the data protection principles in the Data Protection Act 2018 and UK GDPR. In particular, disclosure of the withheld information would contravene the first data protection principle: Lawfulness, fairness and transparency.
