How we will use your information

We will use your information for the following purposes:

  • to help with the detection and prevention of criminal activity within the areas covered by the Mobile CCTV provision
  • to help with the increased apprehension and prosecution of offenders
  • to increase public safety and public reassurance
  • to reduce the fear of crime
  • to address environmental concerns and safeguard assets
  • to support the Council’s risk management arrangements.

The Council is collecting and using this information for the performance of a task carried out in the public interest.

By its very nature, Mobile CCTV may capture sensitive information about people. We also need to process this more sensitive personal information about you for reasons of substantial public interest as set out in the Data Protection Act 2018. It is necessary for us to process it to carry out key functions as set out in law. We may also process data about the commission of offences.

Prior to deployment a site survey will be carried out to ensure deployment is necessary, justifiable and proportionate to achieve a legitimate aim. This being the prevention and detection of crime and antisocial behaviour. Services that may require use includes but is not limited to Scottish Borders Council Safer Communities.

The information you have provided will be retained for approximately 30 days. There may however be occasions where footage is required to be retained for longer period of time.

Who we may share your information with

Your information will be accessed by Council staff who need to use it in order to provide the service described above. Your information will not routinely be shared with any third party organisations.  

The Council is legally obliged to share certain data with other public bodies such as Police Scotland, our Insurer’s etc. and will do so where the law requires.

Your information may also be shared and analysed internally in order to provide management information, inform service delivery reform and similar purposes to meet our duty to achieve best value and continuous service improvement. 

All CCTV data is held within the UK.

Your rights

You have the right to request access to any personal data held about you by the Council. You can also request that we restrict the use of your information or even object to any further processing.  You can do this by contacting the Data Protection Officer using the contact details provided above. We will respond to your request within thirty calendar days.

How to raise a complaint

We aim to directly resolve all complaints about how we handle personal information. If your complaint is about how we have handled your personal information, you can contact the Council's Data Protection Officer by email at dataprotection@scotborders.gov.uk or by telephone on 0300 100 1800.
