Privacy notice
At the Full Council meeting on the 29 August, it was agreed that we will deliver Active Schools and Sports Development from the 1 October 2024.
As part of this transfer we will become the owner (Data Controller) of any open Active Schools and Sports Development data to ensure the successful delivery of these services from this transfer date.
This means that although the way in which your data is captured for Active Schools and Sports Development will remain largely unchanged, we, rather than Live Borders, will receive, store, and use this data for the same reasons from the 1 October 2024. Any personal data that is not required will not be shared, but rather be closed and dealt with through Live Borders’ data retention and destruction process.
However, if your account is open and you would like this to be closed (meaning none of your personal data that Live Borders currently holds will be included in this transfer), please provide details of this, preferably in writing to enquiries@liveborders.org.uk, no later than the 30 September 2024. Your data will then be dealt with through Live Borders’ data retention process instead.

How we will use your information
You are giving us your personal information to enable us to plan and support the delivery of Active Schools and / or Sports Development within the Scottish Borders. The Council is collecting and using this information in the performance of a task carried out in the public interest, which in this case is to ensure the successful delivery of Active Schools and / or Sports Development programmes.
The Council may use your information to contact you by post, email, or telephone and to maintain our records.
The information used will be retained for a minimum period of time (2 years) and then disposed of securely. Information may be retained for longer where we are legally required to do so and where it is appropriate for the service needs e.g. whereby an individual is involved in an accident, this will be retained in line with Health and Safety's retention period. Further information on the retention periods for each data category can be found online.
Who we may share your information with
Your information will be accessed by relevant Council staff who need to use it for the purpose described above.
The Council is obliged to share certain data with other public bodies, such as Sport Scotland, Scottish ClubSport, and will do so where the law requires this. We will also comply with requests for specific information from other regulatory and law enforcement bodies where this is necessary and appropriate.
Where information may be shared with other public bodies such as the Sport Scotland, they will become Data Controller for information shared with them. This is because they will be using your information for their own purposes.
Third Party Information
If you have provided anyone else's details to us, please make sure that you have told them that you have given their information to Scottish Borders Council. We will only use this information to contact them in connection with the delivery of Active Schools and / or Sports Development. If they want any more information on how we will use their information they can visit our website or email dataprotection@scotborders.gov.uk
Your rights
You have the right to request access to any personal information held about you by the Council. You can also request that we restrict the use of your information or even object to any further processing. You can do this by contacting the Data Protection Officer using the contact details provided above. We will respond to your request within thirty calendar days.
